East Volleyball Club (EVC) Cancellation Policy

 Purpose: This policy explains what happens if a registration is cancelled, including any fees or approvals involved.

Scope

This policy applies to:


TERMS AND CONDITIONS 

3.1 The participant (class participant or athlete) enters into a contractual relationship upon acceptance of all the terms and conditions and athlete code of conducts.

3.2 The participant is bound to the Agreement. It does not matter if the payment of fees is paid by someone other than the participant (e.g. a parent, guardian, sponsor/funder or any other third party), the contract is with the participant who will be the beneficiary of the services and material.

3.3 The right to the classes and club affiliation is not transferable.

3.4 Participants will NOT be charged a 'change of course fee' should they wish to transfer from one class to another.

3.5 Transferring from one class or team to another or from one mode of delivery to another will be dealt with on an individual basis and will be subject to the approval of coaches.

3.5 Participants are responsible for ensuring that they are registered for the correct classes or team and that they adhere to the latest and correct terms and conditions. EVC will not accept participants who do not adhere to the entrance requirements for the classes they registered for. EVC may cancel the registration of participants who registered without adhering to the entrance criteria for their chosen activity. 


4. CANCELLATIONS 

4.1 Cancellation of Registration 

4.1.1 Participants remain liable for any amounts owed to EVC as at the date of written notice of cancellation.

4.1.2 Participants have the right to cancel any advanced registrations and can claim a refund; however, EVC may impose a reasonable charge for such cancellation but may not withhold the entire amount paid.

4.1.3 Participants who pre-pay for a term and are unable to attend may request a credit towards a future term, subject to availability and any applicable fees.

4.1.4 A cancellation fee may not be charged where the participant is unable to commence his or her activity due to the death or hospitalisation of the participant. Similarly, no cancellation fee may be charged to a third party who is unable to honour the registration due to the death or hospitalisation of the participant. 

4.1.5 No refund will be provided if the training has already been delivered to the participant at the time of cancellation for more than two weeks. 

4.2 Cancellation of participant before completion 

4.2.1 In the event that participants cancel their enrollment before completion of a term, EVC will be entitled to claim payment for the whole term. 

4.2.2 If participants have paid their total fees in advance, but cancel their participation prior to completing the term or the competitive year, EVC will charge the participant for all training planned for the term and must refund the participant the remainder of the fees paid in advance, however EVC will also charge a cancellation fee of 20$.

4.3 Cancellation due to unforeseen circumstances 

4.3.1 EVC may not accept any payment from participants when it is unable to provide the programme due to insufficient numbers, change of programme or training venue. 

4.3.2 If EVC accepts such payment and then is unable to provide the training to the participants, EVC must refund the students the amount paid. 

4.4 Participant's Registration cancelled by EVC

4.4.1 EVC reserves the right to cancel a participant's registration due to any infringement or disregard of the organisation's rules and regulations as stipulated in the Athlete Code of Conduct and Terms & Conditions. 

4.4.2 Participants who are on instalment payment plans will not and cannot claim any refund if EVC cancels their registrations. If EVC chooses to cancel the registration of a participant who has paid for the programme in advance, such a participant is not entitled to a refund. 

4.4.3 In the event that EVC cancels a participant enrollment before completion of a term, EVC will be entitled to claim payment for the whole term and any outstanding payment for the past terms. 

4.5 Registration cancelled by participant

4.5.1 In the event of any participant cancelling his/her activities for any reason whatsoever, this does not absolve the participant from full liability for the payment of fees and any other charges, and shall be dealt with in accordance with the cancellation and refund policy. 

4.5.2 The participant's failure to make progress with his/her abilities, or to complete a class or training session for whatever reason, shall in no ways entitle him/her to a reduction in fees, a refund on fees paid in advance nor will it absolve him/her from full liability for outstanding payment of fees and other charges. 

4.5.3 Participants requesting cancellation are required to send a formal request to EVC mailbox (eastvolleyballclub@gmail.com) and indicate one or more relevant grounds for cancellation.

4.5.4 After the participant's account has been validated, the grounds for cancellation will be considered by the coaches and submitted to the board for final approval.
